he government has announced the Local Housing Allowance cap will apply to all tenants who receive Universal Credit, in a significant change that could affect thousands of tenants.
In a ministerial statement today Lord Freud announced the LHA cap for general needs accommodation will be pushed back a year to 2019.
However, it will now apply to all tenants on universal credit, rather than just those who sign new or re-let tenancies, which was the previous policy. Work and pensions minister Lord Freud said this would “ensure simplicity and a streamlined process”.
Gill Payne, director of policy and external affairs at the National Housing Federation said: “Our primary concerns are for those under 35 on the lower shared accommodation rate of Local Housing Allowance. The Federation will be talking to government about safeguards for vulnerable people on this rate, for example those leaving supported housing, homeless people and pregnant women.”
Lord Freud said tenants who are moved from housing benefit onto Universal Credit after April 2019 will be protected “in cash terms” under a transitional arrangement. Inside Housing has requested additional information on what this will involve.
Claimants with tenancies signed before April 2016 who move back onto housing benefit once they reach state pension age will be protected, but no assurances were given regarding the position of tenants already on Universal Credit.
Ms Payne said the NHF would also be “pressing for more protection for those who are already on Universal Credit or move onto it before 2019.”
For tenants on housing benefit, not Universal Credit, the cap will still only apply to those who signed a new or re-let tenancy after April 2016.
The government already announced the cap would apply to all supported housing tenants, a change from previous policy where it would only apply to new tenants.
It is not clear yet exactly how many tenants could be affected by this change in policy. In its roll out of Universal Credit the government had originally intended seven million people to be claimants by the end of 2019. However, work and pensions secretary Damian Green has recently announced a delay to the roll-out.
Stuart Ropke, chief executive at Community Housing Cymru said: “This policy is bad news for tenants. Many people will be forced to make very difficult decisions about how they could make up the shortfall between what they received in benefits and their rent. It is now crucial that transitional protection is available for all who need it and who will be affected by this policy in Wales”
He added: “Our members will continue to support tenants, however it will also impact on them and their ability to invest in new and existing homes. In recent years, Welsh housing associations have led the way in providing much needed social housing. If their rental income is affected by this change to benefits they will undoubtedly have less money to spend.”
Re.Pay To Stay u-turn,there already is a voluntary scheme at £60,000,since 2012,for LA's take up =0.
